Welcome to WalkSafe (“WalkSafe,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website located at [walksafenow.com] (the “Site”) and any related content, features, communications, or services made available through the Site (collectively, the “Services”).
By using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site.
1) Eligibility
You must be capable of forming a legally binding contract to use the Site. If you are under the age of majority in your province/territory, you may only use the Site with consent of a parent or legal guardian.

WalkSafe is intended to support safer awareness and decision-making. It does not guarantee avoidance of collisions, injuries, property damage, or other harm.
You acknowledge and agree that:
you remain solely responsible for your own actions and safety at all times;
drivers must obey all traffic laws, remain attentive, and never rely exclusively on any alerting technology;
pedestrians must remain alert, follow traffic signals, and use crossings responsibly;
the Services may be affected by conditions including (without limitation) device limitations, network connectivity, GPS accuracy, building/terrain obstruction, weather, traffic conditions, latency, software errors, or user behaviour.
4) No Professional Advice
Nothing on the Site constitutes legal, medical, safety, engineering, or other professional advice. You should seek professional guidance appropriate to your situation.
5) Intellectual Property
All content on the Site (including text, graphics, logos, icons, images, software, and design) is owned by WalkSafe or its licensors and is protected by Canadian and international intellectual property laws.
You may view and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from the Site without our prior written consent.
6) Acceptable Use
You agree not to:
use the Site in any way that violates applicable laws;
interfere with or disrupt the Site or attempt to gain unauthorized access;
introduce malicious code (viruses, malware, etc.);
scrape, harvest, or collect data from the Site without permission;
misrepresent your identity or affiliation.

Where liability cannot be excluded, our total liability will be limited to the greater of:
(a) amounts paid by you to WalkSafe for Site access in the prior 12 months (if any), or
(b) CAD $100.
11) Indemnity
You agree to indemnify and hold harmless WalkSafe and its directors, officers, employees, contractors, agents, and affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Site, violation of these Terms, or infringement of any rights of a third party.
12) Privacy
Your use of the Site is also governed by our Privacy Policy (below). By using the Site, you consent to the collection, use, and disclosure of information as described in that policy.
13) Governing Law and Venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario.
14) Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will reflect changes. Your continued use of the Site after changes means you accept the updated Terms.
